Arbitration Agreement & Legal Notice

By accessing this website and/or purchasing from House of MyNia, you agree to the following terms regarding dispute resolution, liability, and responsible ownership:


Agreement to Arbitrate

Any dispute, claim, or controversy arising out of or relating to your purchase, use of our website, or any product sold by House of MyNia shall be resolved exclusively through binding arbitration, rather than in court.

This includes, but is not limited to:

  • Product-related disputes
  • Shipping or delivery issues
  • Refund or policy disputes
  • Claims relating to live animals or plants

Selection of Arbitrator

You agree that House of MyNia will have the sole right to select the arbitration organization and/or the neutral arbitrator who will preside over the dispute, subject to applicable laws governing neutrality and fairness.


Waiver of Jury Trial

By agreeing to these terms, you waive your right to a trial by jury and agree that any disputes will be resolved through arbitration.


Waiver of Class Actions

You agree that any claims will be brought individually and not as part of a class action, collective action, or representative proceeding.


Limitation of Liability (Animals)

By purchasing any live animal from House of MyNia, you acknowledge and agree that:

  • All animals, including but not limited to tarantulas, insects, reptiles, and other exotic species, may bite, sting, or cause injury
  • You assume full responsibility and risk for the handling, care, and interaction with any animal purchased
  • House of MyNia shall not be held legally liable for any injuries, bites, allergic reactions, or damages resulting from the ownership, handling, or interaction with any animal purchased from us

Transfer of Responsibility

Once a live animal is delivered and confirmed to have arrived in good health, full responsibility for the animal transfers to the buyer.

  • House of MyNia is not responsible for the animal’s care, condition, or well-being after successful delivery
  • It is the buyer’s responsibility to provide proper care, housing, and environment immediately upon arrival
  • Failure to properly care for the animal after delivery is the sole responsibility of the buyer

Arbitration Process

Arbitration shall be conducted by a neutral, independent arbitrator in accordance with the rules of a recognized arbitration organization (such as the American Arbitration Association, where applicable), unless otherwise determined by House of MyNia.

  • The arbitration will take place in a location determined by House of MyNia, unless otherwise required by law
  • Each party will be responsible for their own legal fees unless otherwise required by applicable law

Governing Law

This agreement shall be governed by and interpreted in accordance with the laws of the state in which House of MyNia operates, without regard to conflict of law principles.


Exceptions

House of MyNia reserves the right to seek injunctive or equitable relief in a court of law for issues involving:

  • Intellectual property
  • Fraud
  • Misuse of the website or business

Acknowledgment

By purchasing from House of MyNia, you acknowledge that you have read, understood, and agree to be bound by this Arbitration Agreement, Limitation of Liability, and Transfer of Responsibility.
